Newsflash: CJRS guidance update

In our last Employment Law Now, we outlined the Government’s latest updates to the Coronavirus Job Retention Scheme (“CJRS”). One of those updates related to an employer’s eligibility to claim for employees serving contractual or statutory notice periods for claim periods starting on or after 1 December 2020 and the Government said that further guidance on this point would be issued.

That further guidance has now been issued and it confirms that:

1. An employer cannot claim for any days on or after 1 December 2020 during which an employee was serving a contractual or statutory notice period (and this includes people serving notice of retirement or resignation).

2. For claim periods starting before 1 December 2020, claims may be made if the employee is serving statutory notice only – but the guidance is currently silent on what happens with contractual notice.
