Clarity is key, whether as to process, cost, strength of claim or the inevitable risk factors. We ensure that from the outset of a dispute and throughout its life we give the clearest of advice on these points, and assist our clients in forming the appropriate strategy to meet the desired outcome – whether this is fighting the matter to a final award or judgment, or the earliest achievable exit.

As part of that, we strive to ensure there are no illusions, and no surprises. Where there is uncertainty we identify what that is, and what should be done to address it. And if developments mean that the strategy and/or desired outcome needs review, then we are quick to do so.

We work for a range of companies that operate internationally, across a variety of sectors, and for whom a choice of law and jurisdiction clause is fundamental for their contracts. The team is led by Euan Palmer and Russell Strong, each with their own international background, experience in working with foreign laws and jurisdictions, and each with an ongoing and measured desire to win. Euan and Russell have long experience in international disputes, both with disputes going through the courts, or via arbitration in the major arbitral institutions (including the ICC, LCIA, SIAC and LMAA).

Whilst we enjoy expertise across a number of sectors, we have particular focus on disputes coming out of the Energy, Oil & Gas and International Trade sectors.

Resolution

We are experts in international dispute resolution in all its forms, whether litigation in the English courts at all levels, arbitration, formal alternative dispute resolution (mediation, expert determination), or informal negotiations.

Oil & Gas

We enjoy particular expertise and experience in disputes coming out of the O&G sector. We act on both sides of the Operator/Contractor disputes arising out of drilling operations (onshore and offshore), and also Operator/Non-operator disputes arising out of transportation and asset sharing agreements, farm-ins, joint ventures, and other inter-operator agreements.

International Arbitration

We run disputes arising in different sectors through all the major arbitral institutions, including the ICC, LCIA, SIAC, LMAA, as well as ad hoc proceedings. We know when to turn to the courts (whether in England or in other jurisdictions) to obtain support necessary for the arbitral process.

Injunctions

We can bring and defend emergency injunctions to protect you from being prejudiced from any ongoing harm. We understand that there will be situations where a client needs to urgently preserve or prevent the loss of a valuable asset, protect itself against financial harm, prevent loss or damage to its reputation or to safeguard its confidential information.

International and Cross Border litigation

The majority of our clients operate internationally, and we deal regularly with jurisdictional issues arising from the outset of disputes, including as to which country proceedings are best commenced in, or where and how enforcement will take place. Our work will commonly involve either instructing or liaising with lawyers in foreign jurisdictions

We can advise you on when to engage in ADR, and which form of ADR best meets your tactical and commercial aims.
