FIND A LAWYER

No illusions, no surprises

International Litigation & Arbitration

Clarity is key, whether as to process, cost, strength of claim or the inevitable risk factors.  We ensure that from the outset of a dispute and throughout its life, we give the clearest of advice on these points and form the appropriate strategy to meet the desired outcome – whether this is fighting the matter to a final award or judgment or the earliest achievable exit.

As part of that, we strive to ensure there are no illusions and no surprises.  Where there is uncertainty, we identify what that is and what should be done to address it.  And if developments mean that the strategy and/or desired outcome needs review, then we are quick to do so.

We work for a range of companies, high net worth individuals that operate internationally, across a variety of sectors, and for whom a choice of law and jurisdiction clause is fundamental for their contracts.  We frequently deal with international disputes and have experience in working with foreign laws and jurisdictions (alongside trusted foreign lawyers where appropriate) and an ongoing and measured desire to win.

Our experience in international disputes and arbitration is impressive.  It includes dealing with complex webs of cross-border litigation with interrelated disputes simultaneously going through the courts in several jurisdictions, complex international disputes with values of over £100m, litigation involving foreign state entities, and arbitration – often where a neutral and confidential resolution forum is preferred – in all the major arbitral institutions (including the ICC, LCIA, SIAC, LMAA and UCITRAL).

What stands us apart from other firms is our ability to deliver a responsive and personable approach when providing pragmatic and commercial advice.  That can be invaluable when handling complex international disputes with high-value issues in high-pressure environments.

Whilst we have international expertise across a number of sectors, we have a strong reputation for delivering results on disputes coming out of the Energy and Oil & Gas, Construction and International Trade sectors.

How we can help

International and Cross Border Litigation

Most of our clients operate internationally, and we regularly deal with jurisdictional issues arising from the outset of disputes, including as to which country proceedings are best commenced in, or where and how enforcement will take place.  Our work will commonly involve either instructing or liaising with trusted lawyers with expert knowledge of each locality, particularly in circumstances where the litigation is not limited to one jurisdiction.

Injunctions

We can bring and defend emergency injunctions to protect you from being prejudiced from any ongoing harm.  We understand that there will be situations where a client needs to urgently preserve or prevent the loss of a valuable asset, protect itself against financial harm, prevent loss or damage to its reputation or safeguard its confidential information.

Resolution & Settlement

We are experts in international dispute resolution in all its forms, whether litigation in the English courts at all levels, arbitration, formal alternative dispute resolution (mediation, expert determination), or informal negotiations.  We can advise you on when to engage in alternative dispute resolution (ADR), and which form of ADR best meets your tactical and commercial aims.

Energy and Oil & Gas

We enjoy particular expertise and experience in disputes coming out of the Energy and Oil & Gas industries.  We act on both sides of the Operator/Contractor disputes arising out of drilling operations (onshore and offshore) and also Operator/Non-operator disputes arising out of transportation and asset sharing agreements, farm-ins, joint ventures, and other inter-operator agreements.

International Arbitration

We run disputes arising in different sectors through all the major arbitral institutions, including the ICC, LCIA, SIAC, LMAA, as well as ad hoc proceedings.  We know when to turn to the courts (whether in England or in other jurisdictions) to obtain support necessary for the arbitral process.

International Trade

We frequently advise on issues concerning international trade and arising out of the international carriage of goods.  Our experience includes the major arbitral forums and specialist maritime procedures such as LMAA, GAFTA and SCMA.

International Construction

We advise international clients that operate in the construction industry across multi-jurisdictions.  We are regularly involved in international arbitration and court litigation up to Supreme Court level in various jurisdictions.
