Service Charge Dispute

Acting for a freeholder in defending a wide‑ranging service charge challenge brought by leaseholders across several blocks on a large residential estate.

The leaseholders relied heavily on challenging the technical interpretation of the leases to argue that numerous charges were not recoverable or had been wrongly apportioned, and raised wider complaints about reasonableness and transparency.

We focused on what the leases actually allowed, the legal reasonableness test, and the realities of managing a complex development.  The Tribunal broadly agreed with the freeholder.  It was confirmed that the majority of the charges were recoverable where decisions had been made sensibly and with professional input.
