Boundary Dispute

Acting for a Defendant in a residential boundary dispute following a newly erected fence. The Claimant sought an injunction and damages, arguing that the fence should be rebuilt.

We focused on the evidential weaknesses in the Claimant’s case and the legal principles governing boundary determination. It was further argued that any trespass was minimal.  The Court dismissed the claim in full, refused injunctive relief, and awarded costs to the Defendant.
